Privacy Policy

What we collect, why we collect it, how long we keep it, and what you can ask us to do about it.

1. Who we are

PingSphere ("we", "us") provides network engineering, hardware supply and software development services. For the purposes of the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), we act as a personal information controller for data we collect directly, and as a personal information processor for data we handle on behalf of a client under a services agreement.

2. Information we collect

2.1 Information you give us

  • Contact details — name, company, email address and phone number submitted through our enquiry form or sent to us directly.
  • Project information — the technical and business details you share so we can scope and deliver work.
  • Billing details — the information needed to raise and settle invoices.

2.2 Information collected automatically

  • Server logs — IP address, user agent, requested URL and timestamp, retained for security and diagnostic purposes.
  • Cookies — this website sets no advertising or tracking cookies. Any strictly necessary cookies are limited to keeping the site functioning.

2.3 Client system data

When we operate a system for you — a billing platform, a notification gateway, a custom application — that system may contain personal data about your customers or staff. We process that data only on your documented instructions, for the duration of our agreement, under the terms of that agreement.

3. Why we process it

  • To respond to your enquiry and prepare a proposal.
  • To deliver, support and maintain the services you have engaged us for.
  • To issue invoices and keep accounting records required by law.
  • To secure our systems, investigate incidents and prevent abuse.
  • To comply with legal, regulatory and tax obligations.

We rely on your consent, the performance of a contract, our legitimate interests in operating the business securely, and compliance with legal obligations — as applicable to each purpose above.

4. What we do not do

We do not sell personal data. We do not share your contact details with advertisers or data brokers. We do not use information gathered while delivering your project for any purpose other than delivering your project.

5. Sharing and sub-processors

We share personal data only with:

  • Service providers we rely on to operate — hosting, email delivery, payment processing and error monitoring — each bound by confidentiality and data protection obligations.
  • Professional advisers such as accountants and legal counsel, where necessary.
  • Authorities, where we are legally required to disclose.

A current list of sub-processors is available on request.

6. Retention

  • Enquiries that do not proceed — deleted within 24 months.
  • Client project records — retained for the life of the engagement and for 5 years afterwards, or longer where tax law requires.
  • Server logs — typically 90 days.
  • Client system data we process for you — returned or securely deleted on termination, per your instructions.

7. Security

We apply the same standards to our own systems that we recommend to clients: least-privilege access, key-based authentication, encryption in transit, encrypted backups, network segmentation and prompt patching. Access to client data is limited to the engineers assigned to that engagement.

No system is perfectly secure. If a breach occurs that is likely to cause you serious harm, we will notify you and the National Privacy Commission within the timeframes required by law.

8. Your rights

Under the Data Privacy Act you have the right to:

  • Be informed about how your data is processed.
  • Access the personal data we hold about you.
  • Have inaccurate or outdated data corrected.
  • Object to processing, or withdraw consent where consent is the basis.
  • Request erasure or blocking, subject to our legal retention obligations.
  • Data portability, where technically feasible.
  • Lodge a complaint with the National Privacy Commission.

9. Third-party content

This site loads web fonts from Google Fonts, so your browser makes a request to Google when a page loads. That request is subject to Google's own privacy terms. Links to external sites are outside our control and outside this policy.

10. Children

Our services are directed at businesses. We do not knowingly collect personal data from anyone under 18 through this website. If you believe we have, contact us and we will delete it.

11. Changes to this policy

We will update this page when our practices change and revise the date at the top. For material changes affecting active clients, we will notify you directly rather than relying on this page alone.
